An attorney for a large FCM told FO Week that Eurex could indeed have a case against the Chicago exchanges.
"It's very difficult to prevail in any kind of anti-trust action, but my own gut feeling is their claims here are not that unsympathetic," the source said. "And it's a shame that members' fees are being utilised to subvert competition and fight a lawsuit. I can see member fees being used to better their electronic trading systems and lower member fees."
At issue is whether the Chicago exchanges used a monopolistic position to prevent Eurex from competing in the US. Eurex's claims that CBoT and CME overstepped its boundaries when it offered compensation....
