ESpeed, the electronic trading platform, is pushing forward an appeal in its patent case against Trading Technologies, the independent software vendor. The case is likely to hinge on several legal technicalities concerning TTs patent for its MD Trader software.
ESpeed filed its appeal with the federal appellate court in Washington, DC on January 8, arguing that the invention had been offered for sale by TT more than a year before it filed for the patent with the US Patent and Trademark Office (USPTO), which therefore would invalidate the patent.
